Stamp Duty and Registration Fees by Document Type

Percentages apply to the market value — the higher of the sale price and the guideline value — unless the table says otherwise. Many older guides still show a 4% registration fee; that rate was cut to 2% from 1 April 2023.

How Stamp Duty Is Calculated in Tamil Nadu

Both stamp duty and registration fee are worked out on the market value — the higher of the price written in the deed and the guideline value. Writing a lower price does not lower the duty. For a constructed property, work out the building portion with our building value calculator guide.

Base value = higher of (sale price, guideline value)
Stamp duty = 7% of base  ·  Registration fee = 2% of base

ExamplePriceGuideline valueBase usedStamp dutyReg. feeTotal
Flat in Chennai₹50,00,000₹42,00,000₹50,00,000₹3,50,000₹1,00,000₹4,50,000
Plot sold below guideline value₹30,00,000₹36,00,000₹36,00,000₹2,52,000₹72,000₹3,24,000
Women buyers, small plot₹9,00,000₹8,00,000₹9,00,000₹63,000₹9,000₹72,000

If the duty paid is lower than it should be, the Sub-Registrar can refer the deed under Section 47A of the Indian Stamp Act. The Special Deputy Collector (Stamps) then demands the shortfall with a penalty.

Registration Fee Concession for Women

From 1 April 2025, women buying a property pay a 1% registration fee instead of 2% under G.O. (Ms.) No. 77. Stamp duty stays at 7%.

  • The market value must be ₹10 lakh or less.
  • Every buyer must be a woman — a husband and wife buying together do not qualify.
  • It covers houses, plots and agricultural land.
  • A property cannot be split into smaller deeds to claim the concession.
  • Fees paid before the order came into effect are not refunded.

Stamp Duty for Family Settlement, Partition and Release Deeds

Transfers within the family cost far less than a sale. A settlement deed in favour of a family member, a partition among family members and a release among family members each attract 1% stamp duty capped at ₹40,000, and a 1% registration fee capped at ₹10,000.

Example: a father settles a house worth ₹80 lakh on his son.

  • Stamp duty: 1% is ₹80,000, but the cap is ₹40,000, so he pays ₹40,000.
  • Registration fee: 1% is ₹80,000, capped at ₹10,000.
  • Total: ₹50,000 — against ₹7,20,000 if the same house were sold at the 9% rate.

Family usually covers spouse, children, grandchildren, parents and siblings. A gift or settlement to anyone outside the family is charged like a sale at 7% plus 2%. Confirm with the Sub-Registrar Office that your relation qualifies before drafting the deed.

EC and Other Charges to Budget For

Stamp duty and registration fee are the main costs, but plan for a few smaller ones too.

  • Encumbrance Certificate: a small fee based on the number of years searched, paid on TNREGINET EC View.
  • Document writer or lawyer: charges for drafting the deed vary by person and city.
  • Patta transfer: a separate small fee to the Revenue Department after registration — check the patta transfer status here.
  • Scanning and copies: minor counter charges at the Sub-Registrar Office.
